ACTION ITEMS:

PRJ04-00382 ZON04-00048. APPLICANT AND PROPERTY OWNER: VIET Q. HO.

A request for a security gate across the driveway access from Brookhurst Road on a site located at 1531 S. Brookhurst Road (on the west side of Brookhurst Road abutting the westbound on ramp to the 91 Freeway (R-3 zone) (Categorically exempt under Section 15332 of CEQA Guidelines) (Continued from May 20, 2004). (MM)

Senior Planner Mullis explained that at the last meeting the Committee was not comfortable with approving the security gate without further study. The Police and Fire Departments agreed to take a second look at the proposed location to see if there was any possible way to approve the gate as proposed with conditions, or if there were any other options. The City would require a man gate, but due to the proposed security gates location the man gate did not line up as it should. There are five tenant parking spaces that would need to be converted to guest parking.

Committee Member Becerra said he took another look at the site, and still feels that the gate, as proposed, would create a hazardous condition. Any vehicle larger than a full-sized car would not fit into the driveway without protruding into the street. The area is not a high crime area and from a security point of view, does not see the need for a security gate. He said the other issue is the gate on adjacent property that has been installed in a similar location. There is some question as to whether it was ever approved. Committee Member Wallin said that because the driveway is so close to an arterial street, he would not support any kind of a security gate. The Committee recommended denial and suggested that Code Enforcement look into whether the gate on the adjacent property was permitted.

A motion was made to deny based on the issues discussed above.

MOTION MADE seconded, and CARRIED unanimously to DENY PRJ04-00382 ZON04-00048: (Resolution No. 368)

There is a 10-day appeal period where any action by this Committee can be appealed to the Planning Commission and ultimately to the City Council. The request may be approved subject to conditions. Minutes of the hearing and a Resolution will be prepared.

PRJ04-00444 ZON04-00052. APPLICANT: ELIZABETH G. NORMAN; PROPERTY OWNER: REGENCY CENTERS.

A request to operate a womens fitness center within a commercial shopping center (Morningside Plaza) on property located at 1030 East Bastanchury Road (southwest corner of Bastanchury Road and Brea Boulevard) (C-1 zone) (Categorically exempt under Section 15301 of CEQA Guidelines) (AKU).

Assistant Planner Kusch stated that the tenant space is approximately 2,261 square feet. From a zoning or land use perspective the City classifies the use as a trade school. Staff reviews the compatibility of the use with the existing tenants and the surrounding land uses. In its review, staff looked at parking in the shopping center. As of May of this year the property had a surplus of parking. The site was approved with 427 parking spaces of which 395 spaces are required resulting in a surplus of 32 parking spaces. Staff took into account a proposal to locate a Starbucks in the Morningside Plaza, and the surplus parking would be reduced to 15 parking spaces. Staff reviewed aerial photographs of 2002-2003 that depicted the use of the parking lot. The parking area located at the rear or south of the shopping center appeared to have adequate parking available.

The applicant has indicated a total of two employees would operate the proposed fitness center. Expected patrons would be 20 per day. The hours of operation would be Mon.-Fri. 7:30 a.m. 8:00 p.m., Sat. 8:00 a.m. 12:30 p.m. For convenience and to alleviate traffic congestion at the front parking area of the shopping center, Staff is suggesting that patrons be told to park in the parking area located at the rear of the property. The proposed tenant space has a door providing direct access from the rear parking area. In addition, the rear parking area is linked to the front area of the shopping center by means of a pedestrian walkway located adjacent to the proposed tenant space. Staff reminded the applicant that there is a sign program for the center and any new signs would need to comply with the sign program. The applicant was invited to elaborate on the operational aspects of the proposed business.

Ms. Elizabeth Norman said that she would prefer to use the exit at the rear closest to the parking area as the entrance. Committee Member Mullis asked if this fitness center is similar to Curves. Ms. Norman explained that the Ladies Workout Express is different from Curves because it emphasizes body composition, offers counseling, and includes floor coaches for safety and motivation. The equipment is a supplement, with 24 workstations proposed. The applicant operates one other fitness center located in the City of Orange.

Committee Member Tabatabaee asked that plans show the existing path of travel from the parking area, and from the disabled access to the work area. The landing and bathrooms must also be in compliance with the disabled access requirements. The existing unisex bathrooms would be allowed to remain. Both points of access must comply with handicapped requirements. A ramp would be the best solution given the height of the stairs. Committee Member Becerra inquired whether there would be any modifications to the front of the windows in terms of visibility. Ms. Kim Norman said that the windows would be lightly frosted across the bottom to give a degree of privacy.

Committee Member Mullis asked whether 24 stations was the maximum number of workstations envisioned. Ms. Norman said they would like to be permitted for 26 stations in case a new type of machine became available. Committee Member Mullis advised that staff must limit the number of workstations to a maximum number in order to control the use for the future. Committee Member Wallin recommended that the applicant discuss with Water Engineering whether a water upgrade would be necessary.

A motion was made to approve the project subject to conditions.

MOTION MADE seconded, and CARRIED unanimously to APPROVE PRJ04-00444 ZON04-00052 as conditioned below. (Resolution No. 369).

1. Final building plans shall comply with the Americans Disabilities Act Guidelines and the 2001 Building Code requirements prior to issuance of permits. That all corrections generated through the plan check and inspection processes are incorporated by reference as conditions of approval and would include any requirements generated by the Engineering, Building and Fire.

2. A site plan showing the path of travel shall be submitted.

3. Approval of the minor site plan application is for a personal exercise facility that is comprised of a maximum of 26 stations in a circuit system layout. Any subsequent exercise facility shall be of similar size and operational characteristics.
