RDRC Minutes September 9, 2004

CALL TO ORDER:

The meeting was called to order at 4:15 p.m. by Chairman Daybell

ROLL CALL:

COMMITTEE MEMBERS PRESENT: Chairman Daybell, Committee Members, Duncan, Johnson
COMMITTEE MEMBERS ABSENT: Vice-Chair Silber, Committee Member Coffman
PUBLIC PRESENT: Mark Blumer, Derek Gingerich, Rick Crane, Marguerite Hanigan, Tamara Storms, Tom Dalton, Bob Winkleman
STAFF PRESENT: Chief Planner Rosen, Associate Planner Eastman, and Clerical Support Dew

MINUTES:

The approval of the minutes of the August 12, 2004 and August 26, 2004 meetings were delayed until the September 23, 2004 meeting to allow members additional time for review.

NEW BUSINESS:

  • ITEM 1
    PRJ04-00775 ZON04-00076. APPLICANT: MARK BLUMER; PROPERTY OWNER: MGC HOMES, INC. (239 W. MALVERN AVENUE)

    Associate Planner Eastman presented the proposed project. He stated that it was a request to construct a second unit on a R-2P zoned property and construct an additional bedroom to the existing dwelling. The request is being reviewed by the RDRC because it is located in a preservation zone. Staff reviewed the project, and it meets all the code requirements, except for one minor deviation of two inches. Staff recommended approval of the project with conditions as listed in the staff report. The applicant has reviewed the conditions and the client has found them acceptable.

    There being no questions for staff, Chairman Daybell opened the discussion to the public.

    Tom Dalton, President of Fullerton Heritage, stated that he had reviewed the drawings and was very pleased with the plans.

    Committee Member Duncan, asked Mr. Blumer about the second story deck railing of the proposed new unit. Mr. Blumer stated that the submitted drawings are incorrect, and that there will be an open railing all around the deck.

    Committee Member Johnson asked Mr. Blumer about the chimney clearance. Mr. Blumer stated that the chimney was based on code, and needed to be two feet higher than any roof within ten feet horizontally from it.

    Mr. Bob Winkleman, a resident of Fullerton, was concerned about the lot line, and wanted to know where the 400 square feet was going to be located. Associate Planner Eastman presented Mr. Winkleman with a copy of the plan. Mr. Winkleman stated that he did not think this addition would be offensive to the neighborhood and had no further concerns.

    There being no further public comments, Chairman Daybell turned the meeting over to the Committee Members for discussion.

    Committee Member Duncan stated that he supported the project with staffs recommendations.

    Committee Member Johnson also supported the project including staffs recommendations.

    Chairman Daybell agreed and acknowledged Crane and Associates for another job well done.

    Committee Member Johnson moved, and Duncan seconded, to approve Project PRJ04-00076 as proposed with staffs recommendations. The motion passed unanimously.

  • ITEM 2
    PRJO4-00807 ZON04-00081. APPLICANT: TAMARA STORMS; 329 JACARANDA PLACE.

    Associate Planner Eastman reported that this was a request to add a limited second dwelling unit with an attached two-car garage. This project is located in an historic R-1- 7.2P zoned property. This unit is also referred to as a granny unit and will be 400 square feet in size. Associate Planner Eastman explained that the State passed a law last year, which requires that the City can no longer process limited second dwelling units by Conditional Use Permit. The City has adopted additional regulations that were not in place prior to June, which restricted parking and limits the size of the new unit to thirty percent of the existing dwelling, among other things. The project proposed meets all these criteria. Staff has reviewed the project and feels that this project is compatible and has recommended approval subject to a number of conditions, which have been outlined in the staff report. The applicant has reviewed the staff report and has no objections to the conditions.

    There being no questions for staff, Chairman Daybell opened the discussion to the public.

    Mr. Tom Dalton, President Fullerton Heritage questioned whether this addition met the requirements on the percentage of the lot that could be covered by dwellings. Associate Planner Eastman said the addition did comply with those requirements.

    Mr. Rick Crane inquired if the State had passed legislature, which allows unlimited square footage for second dwelling units. Associate Planner Eastman stated he would look into this matter.

    Mr. Tom Dalton questioned the owner, Tamara Storms, about the windows that would be installed in the second dwelling unit. Ms. Storms replied she would be installing windows to match the house. She explained that the house had a combination of double hung windows and swing in casement windows. She will be using double hung windows for this addition.

    Associate Planner Eastman read a letter from Karen Haluza, who wrote in support of the proposed second dwelling unit. The letter was submitted as part of the record and included in the file.

    There being no further public comments, Chairman Daybell turned the meeting over to the Committee Members for discussion.

    Committee Member Johnson stated he was pleased with the design and is in support of the project as proposed including staff recommendations.

    Committee Member Duncan agreed with Member Johnson and supported the project as proposed with staff recommendations.

    Committee Member Duncan moved, and Member Johnson seconded to approve project PRJ04-00807 including staff recommended conditions. The motion passed unanimously.

  • COMMITTEE MEMBER COMMENTS / STAFF COMMUNICATIONS / PUBLIC COMMENT:

    There was discussion initiated by Mr. Rick Crane regarding the State passing legislature, which allows unlimited square footage for second dwelling units. Associate Planner Eastman stated he would look into this matter.

Adjourment

There being no further business, the meeting was adjourned at 4:45p.m.
